1 Appellant, Howard Lee Glaze, hereinafter referred to as defendant, was convicted upon trial by jury in the District Court, Oklahoma County, Case No. CRF-75-3708, for the offense of Attempted Burglary in the Second Degree, After Former Conviction of a Felony, in violation of 21 O.S. 1971 ? 42 [21-42] and 21 O.S. 1971 ? 1435 [21-1435]. The defendant was sentenced to serve a term of four (4) years in the custody of the Department of Corrections and from said judgment and sentence a timely appeal has been perfected to this Court.
